The DePuy Pinnacle Acetabular Cup System is a full hip replacement manufactured by DePuy Synthes and marketed by Johnson & Johnson. The device was first approved by the U.S. Food and Drug Administration (FDA) in 2000 and was marketed to patients as a long-lasting and reliable implant that ensured comfort and mobility for its users. The cup liner used in the DePuy Pinnacle hip implant was approved by the FDA based on the success of the nearly identical DePuy Ultima Metal-On-Metal Acetabular Cup, which had already been approved. For this reason, the FDA granted the DePuy Pinnacle 501(k) approval, which allowed it to be sold to patients without performing the usual safety tests medical devices undergo before being released into the market.COMPLICATIONS CAUSED BY THE DEPUY PINNACLE
In 2010, a study published in the Journal of Bone and Joint Surgery revealed the metal liner in DePuy Pinnacle and Ultima devices failed in 14 percent of patients. Additionally, health care providers found during revision surgery that patients suffered from fluid buildup in the hip’s pockets, tissue death and ruptured tendons. This can lead to serious health conditions, including:- Metallosis: A type of metal poisoning that occurs when metal fragments release toxic ions into the body.
- Necrosis: The decay of bone and tissue caused by an adverse reaction to metal-on-metal hip implants and metal poisoning.
- Bone fractures: Weakening and breaking of bones around the hip implant.
- Pseudotumors: The formation of tumor-like deposits surrounding the affected joints near the hip implant.
- Loosening of the implant within the body
- Bone fracture at the site of the implant
- Stiffness and loss of mobility
- Implant dislocation
- Muscle damage
- Pain and inflammation surrounding the implant
- Hip instability
- Hip dislocation, making it difficult to walk or stand
DEPUY PINNACLE LINKED TO METALLOSIS
Metallosis occurs when the metal-on-metal liners of the device cause friction between the cup and the ball-shaped replacement head of the thigh bone that releases metal ions into the surrounding muscle tissue. The symptoms of metallosis depend on the amount of metal that has built up and the location within the body in which the substance had collected. A patient suffering from metallosis may experience;- Extreme pain
- Swelling and inflammation
- Dislocation
- Bone deterioration
- Aseptic fibrosis
- Hip replacement failure
- Infection
- Skin rashes
- Heart problems and heart failure
- Thyroid problems
- Nerve complications
WHY ARE DEPUY PINNACLE LAWSUITS BEING FILED?
Many patients who received a defective DePuy Pinnacle Acetabular Cup System may be entitled to compensation through a Pinnacle hip replacement lawsuit. Patients who filed a DePuy Pinnacle lawsuit claim the company, along with parent corporation Johnson & Johnson, knew about the complications associated with the Pinnacle hip replacement. However, both companies failed to warn patients and the medical community about the inherent risks associated with the device. To file a Pinnacle hip lawsuit, you must have suffered an injury related to high metal ion counts in your blood, metallosis, device loosening, device fracture, or the need to undergo revision surgery. During your free consultation, our lawyers will review the circumstances behind your hip implant and the adverse side effects that you have suffered. We will examine how your hip implant has affected your life and whether you have suffered adverse complications since the surgery. If we find that you may have a case against DePuy Synthes and Johnson & Johnson, our Cincinnati attorneys will help you file a DePuy Pinnacle lawsuit to pursue the maximum compensation you may be entitled to receive.DEPUY PINNACLE MDL
The thousands of lawsuits filed against DePuy Synthes and Johnson & Johnson have been consolidated into multidistrict litigation (MDL). An MDL is a special federal legal procedure designed to speed up the litigation process when several complex cases regarding the same issue have been filed around the country. Each case is transferred to one U.S. District Court and overseen by a single federal judge. The DePuy Pinnacle MDL is overseen by the Northern District of Texas and has resulted in more than $1.7 billion in verdicts from bellwether trials, which are lawsuits that act as “test cases” to see how other cases may succeed in front of a jury. As of November 2017, DePuy has lost three out of four Pinnacle bellwether trials. The results from the three successful bellwether trials include:- $502 million jury award to five plaintiffs in March 2016, which was later reduced to $150 million due to Texas’ cap on punitive damages
- $1 billion jury award to six plaintiffs in December 2016, which was later reduced to $543 million
- $247 million verdict for six plaintiffs in November 2017
