Johnson & Johnson Subsidiary To Pay $25M Over Children’s Tylenol Recall
McNeil Consumer Healthcare, a subsidiary of Johnson & Johnson pleaded guilty to a federal criminal charge after investigators found that the company sold over-the-counter children's medications that were defective.
In particular, the company pled guilty to continuing the sales of liquid medicines for infants and toddlers despite knowing that they contained metal particles.
The company agreed to pay $25 million, acknowledging it failed to take corrective action after discovering compromised bottles of Infants' and Children's Tylenol and Children's Motrin.
Signs Of Trouble
While the drugs were finally recalled in 2010, prosecutors said the health care giant first learned about the problem in 2009, but failed to take action.
An FDA investigation into the facility after the recall revealed the medicine wasn't manufactured according to best practices and was in violation of the federal Food, Drug and Cosmetic Act.
An FDA investigation found that the plant producing the medication
contained bacteria in raw materials, poor quality controls and general dirtiness.
Currently, McNeil is operating under an agreement with the FDA that requires increased inspections and oversight at its factories.
